Rejection of TDR Refund for PT Ticket

I filed a TDR on 14th April 2018 for PNR 2725738377 for refund of full fare due to train was delayed by more than three hour. I booked this ticket under premium tatkal. Passanger was not able to travel because of unexpected delay of train no. 12562 Swatantrta Senani Express running between New Delhi to Jainagar. I booked the ticket in the name of AZAD KHAN, M36, 3AC from NDLS-BSB. General Manager office of East Central Railway rejected my claim vide email dated 16th May 2018 stating that no refund for ticket booked under dynamic fare by giving a reference document i.e. commercial circular no 65 of 2015 “refund rules” issued by Director (Passenger Marketing), Railway Board, Delhi. I have gone through the referred documents also and no where it is mentioned that no refund is admissible due to fault of railway also. I presume that it is self-interpretation of Railway. Even if such rule is in existence then I believe that it is against the social justice as well as violation of consumer rights and need to change immediately. Again I requested to the office of GM, East Central Railway as well as Railway Ministry on 22.05.2018. They have rejected my claim again on 09.06.2018. This is completely unjustified for the passenger.
