I had booked a flat (No M102) in MAHIMA REAL ESTATE PVT LTD JAIPUR Panorama project in Oct 2009. As per terms and conditions in no 12, the company would pay charge to allottee Rs. 5/- per sq ft. per month for any delay attributable to the inability of the company subject to force majeure on the handing over of the apartment beyond the committed period i.e. 36 months from the date of excavation. The company has not hand over the apartment on committed period (on December 2010).
I was requested to adjust the amount for delay in possession from Dec 2010 in the final demand letter dated 24.05.2012.
Company not agree to adjust the amount for delay in possession from Dec 2010.
please help me.
