got damaged/used product but not getting refund

Sir/Mam
I ordered one spot removal pen from Amazon by online. I paid money by my debit card ( Rs 5700 before delivering the product). I got my product at 3 February 2017 but when I opened my product I saw the product is already used or damaged bcoz –

1- the product of the box is scratched
2- there is no one in polythene
3 -one needle is out side of the box
4- charger, spot removal pen and other item is already opened

then I did chat with Amazon executives on Amazon website every time they disconnected my chat ( I did chat with 45 executives in last 20 days they asked my problem then they said “we are looking” then they disconnected)
then I got number I called yesterday and told about my product they said please send us images on email I’d then I sent images by email then they replied me we are looking this and asked me you want replace or refund I told refund after some time they told me we will not refund.

now sir I am frustrated bcoz they did fraud with me
I need my refund
please help
