Gaursons is Cancelling flat in Gaur City -1 to sell @ higher price

Location/place: Noida Extnsion

I have booked a flat in Gaur city-1, GC-5 , Noida Extn. in march 2010. i had paid 55% of total Flat Cost by may 2011. Since there was a land

Dispute in that area so bank has stopped the further disbursement till the final hearing/order of the court.

As per the direction/Guidelines of Hon’ Allahabad High Court dated 21st October 2011, The GNIDA has to obtain the NO Objection

Certificate From the respective National Capital region Planning Board (NCR Planning Board). The NCR Planning Board has given the NOC

and advised to resume the Development/Construction w.e.f. 25-08-2012.

I received one letter with Demand from Gaur which says if you want to discontinue we can refund your total amount with 11% of interest if

not then you need to sign the New agreement according to which there will be increase in FAR and possession postponed for 2 ear i.e

Septemeber 2014.

I signed all the doc. and given them a check of all the interest pending i.e about 40K on 14 November 2012.

I had loan from Idbi Bank which was not disbursing at till Decemebr 2012. Bank has staretd disbursement by Jan 1st week and intrusted

builder to raise fresh demand.

Gaur has raised one Reminder Cum Cancellation on 11-Jan-2013 and purposly send it on 14th Jan @ about 17.00PM . Again i received one more speed post which was posted on 20-jan-2013 that is my flat cancellation letter.

Since then i am roaming to gaur to revive my flat and they are asking me new price i.e 3300/Sq. ft. I had approached to creadi for the same

but how they will help me…. they are favouring the builder.

I am filling case against Gaursons in Allahabad High Court. I will fight to get the Justice.

    This is a very serious issue faced by buyers and I am also who have faced the similar problem with gaursons. After some efforts I could sort out the issue. Fortunately I could interact with some right concerned persons from gaursons and they helped me to sort this out. i suggest you to talk with the builder Team they can help you.

    this was the case with number of buyers i was also faced the same situation. but builder did not ask me to cancel flat or something the only thing they asked me to pay 50 rs extra per square feet. reason being after court gave NOC to gaur city project after land dispute, government asked to pay 80 rs extra to farmers as per court order so builder paid 30 rs and asked buyers to pay 50 rs extra for per square feet. i bought at 1600 rs square feet and by the time dispute get resolved the price hiked to 2600 rs per square feet for the property so that was not a big deal if we had to pay 50 rs extra for per square feet. now the project is completed and possession is done. families living here with large amenities and good infrastructure.

    yes mr. vats. that’s right. builder only charged some nominal charges extra after Work started again. and i also bought my flay at gaur city during that phase. yes possession delayed due to that dispute but that is fine it was not builder’s fault. but there was nothing like that about cancellation of booking and all.
