Forced to pay Faulty Charges

Hi Myself Javed Shaikh,

I have taken a personal loan of 1,00,000INR from Fullerton Indian in December 2010 and have signed a ECS with ICICI bank.ECS was suppose to start from Dec month.EMI amount 4000INR per month.

Even after having enough balance in my account ECS was not deducted for 2 months, I realized that the EMI is not debited yet and hence contacted Fullerton India to intimate them about the same.Their executive told be SIR your ECS is having some problem & hencewe will be taking cash from you everymonth I agreed and have paying Cash till date.

I have paid all the ENI’s till date by cash, In the month of feb I enquired with fullerton about everything going fine with my loan account and I dont have any debts,again the executive told me sir no issues your loan account is maintained on time and no isue from our end (fullerton) BUT i had a dought that there is something wrong about my CIBIL record because my credit card is not getting approved from any bank.

Recently I applied for the Car lone and again it was declined because they said my CIBIL is showing negative by 8,000INR and my loan cannot be aproved that was the biggest shock of my life.

I called fullerton headoffice in pune and have asked for the clarification on the same because I have paid all the EMI’s in cash and there should be no outstanding.Mr.Vishal (Senior Client Relations) told me there might be error in their system and they might have not updated the system “BUT THAT IS NOT MY FAULT” even after paying I was ready to pay 8,000INR again to get my CIBIL cleared but they said its not possible and have to wait till 2013 till my loan month comes to an end its very frustrating and unappropriate.

After this I asked for my loan account summary; and again that was a BAD night mare!! They have charged me approximately 1500INR each for 11 cheques,IF my ECS was not active and I have been paying cash then why were my cheques being deposited in the bank.

This is not the way how a finance company works, I am in a big mess and no one is ready to provide me any details and I just have to pay>

I have written a clear mail to fullerton if I dont get proper clarification & my name is not removed from CIBIL i will not be paying any further EMIS.

I have visited the Branch several times from were I have taken a loan (Fullerton Kandiwali Branch) but staff is changed and no one knows whats happning with who’s loan).

I was assisted with executive called Vaishali in Kandiwali branch Mumbai I asked for her and she is not available, other executive tells me to wait untill she comes from her Mertanity Leave.

This is apsolutely NONSENCE and God know why all these extra charges are impossed on me.

One of my friend told me to seek help from Consumer Court and hence expect some kind of help from your end.
