Fabfurnish refund issue

I had purchased a futon with mattress from fabfurnish.com on 17th July 2014. I received the delivery on 28th July 2014, the packing was not good, the carton box was torn & the furniture had scratches & paint scrapped. I called the Bangalore showroom immediately & informed them about the delivery and the condition of the product, but there was no proper response from them. I had to call the local office couple of times and requested them to replace the furniture with a new one, then they informed that I need to call their call center & inform them to take it up further. I called the call center & spoke to Mr. Vaibhav Singh on Aug 1st & Ms. Vanshika Miglani on 4th Aug and informed them about the condition of the furniture & requested them to replace the furniture, but the call center person told me to open the box and take photos of the damages and send it by mail, however I insisted them to send some person from their local office and replace the unit immediately, but they mentioned that first they will send some technical person to inspect the damages & if possible they will fix the issue on the spot. On 4th Aug at 7:00 PM, one person came from local office, but he was not a technical staff, he had come only to assemble the furniture. I took photographs of all the damages as he opened the box. It looked like the furniture might be a returned / refused product as the damages were on every part of the furniture.Upon sending the photographs to fabfurnish, they called me to inform that they would send a technical person to fix the issue. I requested them to take back the furniture & refund the amount immediately, but they were not willing to refund nor replace the unit. They sent a person to apply polish & the product was still looking bad even after applying polish, so I again contacted fabfurnish.com and spoke to Ms. Shivani and conveyed my displeasure in the polishing. They disagreed & told that they cannot help me further. A day later I noticed there were insects in the wood which were making holes in the wood, I informed fabfurnish about the same & sent them photographs & asked them to cancel my order & refund my money. This time they obliged & instead of doing payment reversal to the payment gateway, they transferred the amount of Rs. 11,093 to my personal account on 26th August. I was happy that I could get back my money. Now the problem is that since I had opted for EMI on fabfurnish.com website & made payment through my credit card, the credit card company is still charging me EMIs. All this because fabfurnish.com did not make payment reversal to the payment gateway.

I called up my credit card company on 2nd September & explained the above issue and requested them to cancel my EMIs. I spoke to Ms. Benazir of SBI card. She confirmed that if I paid the entire amount within 3 days and even though I paid the entire amount of Rs. 11093 immediately to my credit card company, I received my next statement on 19th September with the EMIs intact. When I called again to credit card company, they refused to close the EMI and informed me that the payment reversal has to be done from merchant site (fabfurnish.com). If I personally need to close the EMI, then I need to pay foreclosure charges along with interest & service tax. Now I am being charged EMIs monthly. I am paying interest of about Rs. 1000 from my pocket for the fault of fabfurnish.

Now the issue is I am paying EMIs even though I don’t have the furniture with me. I want justice.
